Agreement to Terms

By accessing or using the website of Desert Springs Civil Engineering PLLC (“Company,” “we,” “us,” or “our”), located at desertspringscivil.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this website.


Professional Services

Licensing and Authority

Desert Springs Civil Engineering PLLC is a Professional Limited Liability Company organized under the laws of the State of Idaho. Michael Yoder, PE, is licensed to practice professional engineering in:

  • Idaho — PE License #P-17002

Engineering services are provided only in jurisdictions where properly licensed. All engineering documents are prepared under the responsible charge of a licensed Professional Engineer and bear the appropriate seal and signature as required by state law.

Idaho Professional Engineering Requirements

In accordance with Idaho Code Title 54, Chapter 12 (Idaho Engineering Practice Act) and IDAPA 24.32.01 (Rules of the Board of Professional Engineers and Professional Land Surveyors):

  • All engineering services are performed by or under the direct supervision of a licensed Professional Engineer
  • Engineering documents are sealed and signed in accordance with Idaho Board rules
  • The Company maintains compliance with continuing education requirements
  • Professional liability insurance is maintained as appropriate for services rendered

Scope of Services

Services described on this website are for informational purposes only. Actual scope, deliverables, fees, and terms for any engagement will be defined in a written agreement between the Company and Client prior to commencement of work.

No engineer-client relationship is established by visiting this website, submitting a contact form, or engaging in preliminary discussions.


Limitation of Liability

Professional Standard of Care

Engineering services are performed in accordance with the professional standard of care—that level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions in the same locality.

Limitation

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF DESERT SPRINGS CIVIL ENGINEERING PLLC, ITS OFFICERS, EMPLOYEES, AND AGENTS FOR ANY CLAIMS ARISING OUT OF OR RELATED TO PROFESSIONAL SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law

Dispute Resolution

Mediation

Prior to initiating any legal action, the parties agree to attempt to resolve any dispute through good-faith mediation administered by a mutually agreed-upon mediator in Ada County, Idaho.

Limitation Period

Any claim arising out of or related to these Terms of Service or the use of this website must be brought within one (1) year after the cause of action accrues.


Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this website. Your continued use of the website after any changes constitutes acceptance of the modified terms.


Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
